1. Acceptance of these terms
These terms and conditions ("Terms") govern your purchase and use of the Nifty 50 News Screener application and your use of the niftynewsscreener.com website, both provided by Nifty News Screener ("we", "us"). By downloading, activating or using the application, or by using this website, you agree to these Terms. If you do not agree, do not purchase or use the Service.
2. The product
Nifty 50 News Screener is a Windows desktop application, distributed as a single program file with no installer. It is sold as a one-time purchase: there is no subscription and no recurring fee. Purchases and activation are handled through Gumroad, an independent third-party platform, under Gumroad's own terms in addition to these.
3. Licence grant
Subject to these Terms and payment of the applicable price, we grant you a non-exclusive, non-transferable licence to install and run the application, activated with the email address and licence key issued to you at purchase. Unless stated otherwise on the product page, one licence is for use by one licensed user.
You may not: resell, sublicense or redistribute the application or your licence key; share your licence key with others; reverse-engineer, decompile or disassemble the application except to the extent applicable law expressly permits; or remove or alter any notices contained in the application.
4. Purchases and payment
All purchases are processed by Gumroad. Prices, applicable taxes and accepted payment methods are shown at checkout. We do not receive or store your card details. Your licence key and the application file are delivered to the email address used at checkout.
5. Refunds
Refund requests are considered on a case-by-case basis and, where a refund is issued, it is processed through Gumroad. Contact us at the address below with your order reference if you believe you are entitled to a refund. Purchasing through Gumroad may also entitle you to protections under Gumroad's own buyer policies.
6. Updates
We may release updated versions of the application from time to time. "Check for Updates" in the Help menu opens the product page in your browser, where the current release is listed. Installing an update is your choice; nothing in the application updates itself automatically without your action.
7. Acceptable use
You agree to use the Service only for lawful purposes, and not to use it in any way that could damage, disable or impair it, or interfere with any other person's use of it.
8. No investment advice
The application presents sentiment scores, heatmaps and rule-based signals derived from public news and price data. None of this constitutes investment advice or a recommendation to buy or sell any security. See our Risk Disclaimer for full detail, which forms part of these Terms.
9. Intellectual property
The application, its code, design, text and branding are owned by Nifty News Screener or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you beyond the limited licence described in Section 3. "NIFTY" and "NIFTY 50" are trademarks of their respective owners and are used only to describe the index the application covers; the application is not affiliated with or endorsed by the National Stock Exchange of India Limited or NSE Indices Limited.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that news feeds, price data or signals will be uninterrupted, error-free or accurate.
11. Limitation of liability
To the fullest extent permitted by law, Nifty News Screener will not be liable for any indirect, incidental, special or consequential damages, or for any trading or investment losses, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid for your licence.
12. Termination
We may suspend or revoke a licence if these Terms are materially breached, such as through unauthorised redistribution of a licence key. You may stop using the application at any time; the licence granted to you ends automatically if you do so.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a different governing law is required by the mandatory consumer-protection rules of your own country of residence.
14. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the updated Terms.
